These Terms and Conditions (“Agreement”) govern the purchase and use of all color analysis services (“Services”) provided by MOM STYLE MADE EASY LLC, doing business as MELISSA CONNER & COMPANY (“Company,” “we,” “us,” or “our”), including but not limited to: The Glow Starter™, The Divine Color Experience™, and She’s In Season™ Color Parties.

By purchasing or participating in any of our Services, you (“Client” or “you”) agree to be bound by this Agreement and acknowledge that you have read and understood it in full.

1. Service Description

Our Services include personalized color analysis and related resources intended to help clients make informed choices in wardrobe, makeup, and overall style. Results are based on the information and visuals you provide (for virtual services) or an in-person draping process (for in-person services). While we strive for accuracy and excellence, individual results may vary.

2. Eligibility

You must be at least 18 years old to purchase any Service.

3. Payment Terms

All payments are due at the time of booking. We accept payments via Stripe. Your appointment is not considered confirmed until payment is received.

4. No Refund Policy

All sales are final. Due to the customized nature of our Services, we do not offer refunds under any circumstances, including for missed or canceled appointments. If you are unable to attend your appointment, you may contact us to request a one-time reschedule, subject to availability and at our sole discretion.

5. Client Responsibilities

You are responsible for providing accurate information and following instructions for any virtual service (e.g., submitting photos). Unsatisfactory results due to poor lighting, filters, or incomplete submissions are not the responsibility of the Company.

6. Intellectual Property

All materials provided—including but not limited to color palettes, guides, templates, PDFs, digital products, and instructional content—are the exclusive intellectual property of the Company. These materials are for your personal, non-commercial use only and may not be copied, shared, reproduced, or distributed without our prior written consent.

7. Personal Use & Non-Transferability

Services are non-transferable and intended for the original purchaser or event participant only. Your analysis results and materials may not be shared or applied to others.

8. Limitation of Liability

To the fullest extent permitted by law, the Company disclaims all warranties, express or implied, including but not limited to merchantability and fitness for a particular purpose. We are not liable for any direct, indirect, incidental, consequential, or special damages arising from the use or inability to use the Services. Our total liability, if any, shall not exceed the amount paid by you for the Service.

9. Force Majeure

We are not liable for any failure or delay in performance due to causes beyond our reasonable control, including but not limited to illness, government restrictions, natural disasters, internet failures, or technical interruptions.

10. Modifications to Terms

We reserve the right to update or modify these Terms and Conditions at any time. Updates will take effect upon posting and apply to all future purchases.

11. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of Illinois, without regard to its conflict of law principles.

12. Dispute Resolution

In the event of a dispute, both parties agree to attempt to resolve the issue through informal negotiation first. If unresolved, the dispute shall be submitted to binding arbitration in Wabash County, Illinois, in accordance with the rules of the American Arbitration Association. Each party shall bear its own legal fees and costs.
